New York – Bid Rejected for More Aid to Small-City Schools

    New York – A state appeals court agreed with a lower court’s decision rejecting a lawsuit by a group of small urban school districts seeking billions more in state aid, saying the group lacked the proper standing to sue.

    The decision was another blow to the schools group, the New York State Association of Small City School Districts, which argued that the state had failed in its constitutional duty to provide enough money to ensure New York’s schoolchildren a sound basic education.
    In its decision, the Appellate Division of State Supreme Court in Albany found that the Association of Small City School Districts lacked appropriate standing in the case to sue the state for more money, and that city school districts cannot challenge state government or the State Legislature on constitutional issues.

    The school districts, however, find themselves in a better position than when they lost the first round of the case in State Supreme Court. Under the administration of Gov. Eliot Spitzer, far more school aid and building construction aid is being appropriated by Albany. [AP]
