    Monroe, NY – An appeals court ruled today to allow 8.3 acres in the Town of Monroe to be annexed into the Village of Harriman for senior housing.

    The judgment ended an almost four-year battle that pitted the village’s need for senior housing against the town’s desire for more businesses to offset residential property taxes.

    The property located next to Silver Maples trailer park on Route 17M would be part of an 11-acre project to build 189 apartments for seniors.

    The panel of judges cited two primary reasons for their decision: The topography of the property and a right-of-way have made it economically unfeasible for developers to build commercially on the property vacant for half a century.
    “Therefore, the town’s concern for the loss of commercial tax ratables… is outweighed by the benefit that will inure to the community from much-needed senior citizen housing,” the decision read. [Record]
