    The U.S. Attorney’s office in Albany filed court papers asked a judge to give the disgraced Republican a stiff penalty when he is sentenced on May 6.

    Bruno was convicted in December of two counts of honest services fraud.

    Prosecutors said Bruno abused his powerful position in the legislature by secretly accepting millions of dollars in consulting contracts from companies that do business with the state.

    Bruno’s lawyers said in a filing Friday that he should get no more than six months in jail. They asked U.S. District Judge Gary Sharpe to sentence Bruno to probation and a fine.
    After his retirement, Bruno became chief executive officer of CMA Consulting Services. CMA, an information technology consulting business based in the Albany County suburb of Latham, is headed by Kay McCabe Stafford, the widow of Republican Sen. Ronald Stafford.

    The bigger issue in this case is pending before the US Supreme Court.

    It seems likely that the Court will either greatly limit or eliminate the “honest services fraud” prosecutions, in which case, assuming the court makes the decision retroactive (which it does not always do), Senator Bruno could walk.
