New York – A Brooklyn woman has filed a lawsuit against General Mills, accusing the food giant of making misleading health claims about the popular kid snack Fruit Roll-Ups.

In the class action filed Tuesday in Manhattan Federal Court, Payton McClure says the company lies when it says the rollups, along with Fruit by the Foot and Fruit Gushers, are naturally flavored, low fat, and “a good source of Vitamin C.”
“Unfortunately for consumers and, including children, all these claims are false and misleading,” the $5 million suit says.
Court papers say General Mills failed to note on packaging that it uses partially hydrogenated oil in the snacks, which the lawsuit says is “dangerous” and “unhealthy.”
McClure could not be reached for comment and the law firm representing her did not return calls.
A spokeswoman for General Mills said the company has not yet been served the lawsuit and declined comment.
It probably also has high fructose corn syrup. You might as well chew on plastic.

most processed snacks are unhealthy, it takes years bad food to have a impact 10-20 years of unhealthy food consumption. no wonder people have all sorts of machlehs. i give my children cut fruit, homemade popcorn, and occasional processed snack as not to deprive them. parents this is serious business, companies have no rules, they can basically place whatever they feel like.
i used to be a mashgiach, i was dispatched to MN to inspect a cereal factory, i was shocked to see how it was made. i can honestly say its probably healthier to eat the box then to eat the cereal. since then i read and researched ingredients to discover most additives are dangerous chemicals in disguise. needless to say i refrain from
processed foods. personally i see a difference, since i stopped eating processed foods. i manage on less sleep, have more energy, fi used to have a feel younger ect.

Fruit Rollup? Sounds more like a stickup. Suing for $5 million is preposterous, and this greedy woman and her scumbag lawyer should be made to pay back General Mills for every cent it takes for them to get this idiotic abuse of the justice system thrown out of court.
I’m a dental hygienist and I can tell you firsthand, this is one of the WORST snacks out there, dentally speaking. Try this at home: Have your kid eat a fruit roll-up or fruit by the foot, then ask them to brush their teeth for 2 minutes. Now look in their mouth. I guarantee you will see a mouth full of red. Check an hour later. It will probably still be there. This provides a constant carbohydrate source to feed the bacteria living in the mouth. Bacteria are alive. After they eat, they need to make. They make acid. The acid breaks down enamel. There you have it- rampant decay from a “healthy” snack.
Don’t laugh…before this is over, “high fructose corn syryup” will be the next tobacco and asbestos goldmine for the lawyers. Its also the second most important health issue to the heimeshe community (after salt and saturated fats in process foods)
This woman is so stupid. Doesn’t she know already that if the packaging says “all natural” does not mean that it is all natural. It most probably has 10% fruit juice and the rest is pure junk. I am surprised that you would give your kids this junk!

Okay, I give my kids healthy food as well, but what do you cook with if nothing is processed? I’m a bit confused i mean even tomatoe suace is processed do you have to make your own. I am aware that these foods have chemicals but what other choice is there? should we all live on farms again? I eat like that over pesach and it’s not so easy, we are always hungry, it’s very hard to make food from scratch. it also takes much longer.
The answer is a healthy diet, fruits vegtables and yes occasional snacks are okay.

There are many well run, honorable companies in the food business: I say it’s great that General Mills is being sued for their misleading ads and claims. Because of their size and power, it’s not enough to say just don’t buy. I hope their is an avalanche of suits against outrageous claims made by the food giants. Do your homework see how many times these companies were caught in outright lies by government agencies.

Actually Mrs Yutzface Who Cant Stand Up To Her Children, that is NOT misleading. If you know whats really in there (start by READING the ingredients – IF YOU CAN??!?) and you will see there is a lot of fruit in there. Hence it is NATURALLY FLAVORED, LOW FAT, & A GOOD SOURCE OF VITAMIN C!!
One more thing, just because you cant raise your kids without the govt nanny state involved, doesn’t mean everyone is as stupid as you. Why not do the world a favor and get out of parenting by giving you kids to someone with brains so there could actually be some hope for your kids?

I don’t mind these companies selling non-healthy nosh, it’s their choice. But I always hated when I saw these claims that they’re a great source of vitemins. So I’m glad someone is standing up to them. It’s our kids we’re talking here, don’t feed them your crap under the guise of “health” and expect not to get noticed.

she will lose, assuming general mills grows a pair and doesnt settle, and should be countersued, or penal;ized for the frivolty of this case. unless any flavoring agent was manufactured in a plant from items not found to naturally occur, which by the weay there arent any that are legal in the us, then their claim is pure truth. this claim is there to let parents know that while yes, it is candy, it does have some (not many, but some) good qualities, which your typical, say lollipop, will not have.
this mom should have her kids taken away, since she knowingly, in her mind, endangered their welfare by feeding them dangerous food. this should stop other lame parents from filing frivolous lawsuiits against good companies for their sheer stupidity.
People, you are missing the point here. There are laws about truth in advertising. By advertising lies, the company has opened itself to lawsuits.
Unfortunately there are A LOT of parents who do not know or understand ANYTHING about nutrition, and do not ever read ingredients or nutrition labels and all they have to base their decision on to buy or not buy is a glance at the big words on the front of the box. Well, if the front of the box is full of advertising lies, it’s not just illegal, it’s unfair.
These big companies don’t care that it’s unfair, they don’t care that it’s illegal, they know they will sell more with these lies printed in big colorful font and that’s all they care about. Their money. They certainly do not care your health or their roll in tricking you to damage your health.
The laws are in place for a reason and it’s good that someone is confronting them about breaking the laws. The longer it goes unchallenged, the worse violations will get.

Hashem has given us poison too. That doesn’t mean that it is good “For you”. (It may be good for other purposes though.)
And as long as there are laws in place for “truth in advertising” – for example, making sure the Vitamin & Herbal Supplements have disclaimers etc – then surely the same laws should apply to junk food too.
