Manhattan, NY – A New Jersey housewife has filed a $5 million lawsuit against a store, claiming she was short-changed 80 cents with a coupon fraud “scheme”.

In Manhattan federal court papers, Tova Gerson – a 32-year-old mother of four – claims she used a $5 discount coupon for a purchase of more than $US100 at retailer Century 21’s Paramus, New Jersey, store, the New York Post reports.
When she later returned one item, Century 21 refunded her money – minus the 80 cents she’d saved, on a pro-rated basis, by using the discount coupon.
Century 21’s take-back, she claims, deprived her of the “full benefit” of the $5-off coupon.
Ms Gerson argued that if she’d known she’d lose coupon credit on returned items, she would have purchased them separately.
The class-action suit, which names no other plaintiffs, seeks at least $5 million, and contends that “hundreds or thousands” of other shoppers could also be hurt by the store’s “fraudulent … (and) misleading” promotion.
Ms Gerson’s suit was filed by her father, lawyer Harry Katz, who has a history of similar cases.
Dick’s Sporting Goods, Casual Male and The Children’s Place are among those he’s sued over alleged coupon “schemes.” Those suits were either dismissed or settled.

If I am not mistaken, Century 21 is owned by yidden. Better to be mochel the 80 cents and have your share in olam haba, then to sue in goyishe courts, and get even a penny more then the 80 cents. I have no problem with attorneys making money, but this is litigious and the reason why people dislike attorneys. Yes, in the aggregate, a “scheme” like this can “defraud” thousands, but I think the bad outweighs the good here.
This is a big problem in our country, we are over litigated with these types of nonsense and the courts are drowning with these type of ridiculous lawsuits.
The lady that is suing is one big nut job. The idea of a coupon is for many reasons and one of them being to entice a customer to shop or to make sure there is a miumum shopping order so you save the 5.00
There are no freebies. It is obvious that jerks like the one in the article bought stuff with having in mind to then return items but still save the 5.00 and Century 21 ain’t no idiots and they did not fall for her shtick.
This seems pre meditated on the part of the jerk customer to go around “shopping” and then returning and then suing.

#5 is correct unless there is a real class not just a possible class of plaintiffs.Filing a class action may indeed be good legal tactics on behalf of a client but based on the reported facts this suit is morally defective.
Representing the public is how Lawyers make their money but one should exercise some moral judgment as well

I recently had the very same experience at Macy’s. Gosh! I never even thought of suing as I figured the store has a right to its policies and that I would shop smarter next time. However, it all ads up to what is in the fine print…
THe lawyer will make a couple of hundred thou in legal fees and the consumers will get a 10 cent coupon. This is a scam and the Judge should see through this nareshkeit.

this is a no win suit for the woman if you use a discount ticket you only get back what was paid unless there was a restock clause but if the courts take this ridiculous case then we have sunk to insanity
