New York – A person familiar with the probe says New York officials are investigating health claims and other marketing by energy drink makers.

The person says subpoenas were issued this summer to 5-Hour Energy, AMP, and Monster Beverage Corp. by New York state Attorney General Eric Schneiderman. Speaking on condition of anonymity because the case hasn’t yet been made public, the person confirmed the reports of subpoenas divulged to investors in financial filings by 5-Hour Energy and Monster Beverage Corp.
Michael Jacobson of the Center for Science in the Public Interest says Tuesday that the industry is rightly under scrutiny for health claims and the threat to younger drinkers.
Company officials and Schneiderman declined to comment Tuesday.
Why criminalize these companies from the get go with criminal investigation?
