Cedar Rapids, IA – A judge says it’s going to take time for her to consider the appeal of a former Iowa slaughterhouse manager serving prison time for financial misconduct.

U.S. District Judge Linda Reade said Tuesday she’s started to skim Sholom Rubashkin’s application for post-conviction relief. She told attorneys she has many other appeals to consider before Rubashkin’s, and, “I’m not going to get to this for awhile.”
Rubashkin once ran the Agriprocessors plant in Postville. He’s serving a 27-year prison term after being convicted of defrauding the company’s lender out of millions.
Rubashkin’s appeal argues the government interfered with the plant’s sale, which increased the bank’s losses and led to a longer sentence. It also argues the government should’ve disclosed its contacts with Judge Reade about an immigration raid at the plant.

Why in the world is the same judge (Reade) dealing with the appeal? Does anyone think that she would overturn any part of her own decision?

It is outrageous that you put up an article with such misrepresentation. SMR didn’t defraud the bank. After the raid that brought the plant to a standstill the company couldn’t function forcing on it all the losses resulting in bankruptcy. The company was doing well for years and was current with the bank up until the raid. Please be careful about what you print.
The federal courts are overloaded with appeals and new trials…Congress has slashed the budgets for administrative support staff, law clerks and left vacancies unfilled increasing the caseload for sitting judges. Just about every federal district court is months or years behind in their decisions relative to “suggested” timelines by the judicial conference. I may not be until next year that she will even get around to reviewing the pleadings but his lawyers thusfar have not made a convincing case and have only angered her with their clumsy jury contacts in violation of her instructions.
Waste of time and money. The man is guilty and his illegal workers are still suffering from the abuse he knew about. I am sick and tired of receiving phone calls to donate money for his defense. He should have thought about going to jail before he committed these heinous acts. Instead of arrogance, he should have said he’s sorry and accepted a plea deal. But no, he believed the goyim would believe he is innocent of all 86 counts.

I am specifically talking about those who want to bash me because I believe that Rubashkin stole money from the banks and now has to pay for his crimes. It was not enough that this was the biggest case of Chillul Hashem in the United States. It was not enough that he flagrantly violated laws of immigration for his personal benefit. It was not enough that the company went into bankruptcy for ver $27 million dollars while he sent millions of dollars to his ‘charities’, and used $1,500,000 for himself. These are not my figures, but were in the bankruptcy papers, as files by the court appointed administrator.
Not one of those yeshivas gave back 1 cent of the stolen money. Tells you a lot about the makeup of all those Roshei Yeshivos.
There is always stunning new evidence that is coming out. This “new evidence” is the attorneys’ way of saying, “Pay me more money.
