Orthodox Jews In Brooklyn Hold Massive Protest Against New York’s New Covid Rules

BROOKLYN (JTA) – Protests by Orthodox Jews against New York’s crackdown on gatherings in their neighborhoods turned tense Tuesday night as throngs of young men demonstrated in the streets of Borough Park, setting fire to a pile of masks and at one point running a reporter out of the area.

In a particularly violent episode, one man – the brother of Mordy Getz, a well-known Orthodox businessman in Borough Park who was outspoken about the need for masks and social distancing earlier in the pandemic – was beaten so severely by protesters after he took a video of the scene that he was taken to the hospital. Onlookers could be heard calling him a “moser,” one who informs on fellow Jews to the authorities and who some Jewish legal authorities say can be killed as a result, an insult applied to his brother back in April, as he was placed on a stretcher to be taken to the hospital.


The late-night protest in a heavily Orthodox area of Brooklyn took aim at new restrictions that would close schools, limit attendance at synagogues services and close nonessential businesses in areas with upticks in COVID-19.

The protests — as well as angry statements from leaders in the Orthodox community — gave voice to frustration felt by local Orthodox Jews who are now at the center of the first widespread resurgence of COVID in New York since the spring. Many in the community believe that city and state officials are unfairly targeting Orthodox Jews, who are already vulnerable to anti-Semitism, in their pandemic response.

During the protests, community leaders vowed to resist the new rules through litigation and civil disobedience. “We will not close,” radio host and local celebrity Heshy Tischler proclaimed to cheers from the assembled crowds.

The protests came in response to New York Gov. Andrew Cuomo’s announcement Tuesday afternoon of new restrictions on a large swath of Brooklyn that is experiencing an uptick in COVID cases. His announcement followed a similar one by New York City Mayor Bill de Blasio, who on Sunday, during the Jewish holiday of Sukkot when Orthodox Jews do not use cell phones or computers, said he would move to close schools on Wednesday, pending the governor’s approval. The governor then announced Monday that he would close the schools Tuesday. (Most Orthodox schools are in fact closed this week for Sukkot.)

In a statement Tuesday evening, local Orthodox lawmakers accused New York Gov. Andrew Cuomo of “a duplicitous bait-and-switch.”

“The governor informed Jewish community leaders in a conference call that synagogues in ‘red zones’ would be permitted to operate at 50%, and he requested community cooperation (which he was assured would happen,” they wrote, referencing a call Cuomo held with Orthodox leaders Tuesday before he announced the new restrictions.


“Outrageously, just hours later, Governor Cuomo announced a draconian return to restrictions that would shutter thousands of New York businesses and limit houses of worship to a maximum capacity of 10 (no matter the maximum capacity of the building).”

A statement from Agudath Israel, an organization representing haredi Orthodox communities, also expressed frustration with the lack of notice given about the restrictions in a call earlier in the day and suggested the new rules might be unconstitutional.

“Governor Cuomo’s surprise mass closure announcement today, and limit of 10 individuals per house of worship in ‘red zones,’ is appalling to all people of religion and good faith,” they said.

They seemed to be considering the possibility of challenging the governor’s new restrictions in court. “Agudath Israel intends to explore all appropriate measures to undo this deeply offensive action,” they said. A federal judge issued an injunction blocking New York State from imposing stricter standards on indoor gatherings at religious services than those imposed on other gathering places, citing religious liberty concerns. Agudath Israel filed an amicus brief in that case.

The protesters in Borough Park were joined Tuesday night by Tischler and their City Council representative, Kalman Yeger, who encouraged the crowd to stand up for religious freedom.

“We are not going to be deprived of the right that we have in America, like everybody else in America, the right to observe our religion,” he said in a video posted to Twitter by local news outlet BoroPark24. “I don’t care who in government thinks that they can stop us, they’re wrong. Let them try.”

Tischler also appeared later Tuesday night in Crown Heights, another heavily Orthodox Brooklyn neighborhood where there are no new restrictions but where de Blasio has identified a slight uptick in COVID test positivity rates. Tischler appeared at a Simchat Beit Hashoevah, a gathering on the holiday of Sukkot that is marked by singing and dancing, and addressed the crowd.

“We have a court order, we won, our schools and shuls are open, we will not close,” he said, seemingly referring to a court injunction over the summer issued by a federal judge that blocked New York State from imposing stricter rules on religious gatherings than in other indoor venues.

“And here’s the deal, I’m filing a new court order, I’m holding Cuomo and the idiot de Blasio in contempt,” he said. “We will civil disobedience…our amendments, our first amendments, our rights, we will not close our shuls Simchas Torah!”

Other videos circulated of protesters chanting, “Jewish lives matter.”

At one point, protesters set fire to a pile of masks in the middle of a street.

And one photographer trying to capture the scene in Borough Park was videoed being chased and possibly assaulted by a crowd of Hasidic Jews.

Disgusting, reprehensible behavior by a bunch of hooligans. It is as if the law does not apply to them. In Eretz Yisrael, the cops there would not be so kind, as they would go into that area in force, and take care of the problem, immediately.

When will our community learn? These demonstrations accomplish little to nothing. They irritate some people, and are generally a waste of time. We are in serious need of demonstrating our support via the ballot box. We need to oust these liberals and Jew haters from office. With minor exceptions of some of our local politicians, we need to make sure that no other Democrats get elected. Vote Republican.

These people are BEGGING New York State to close their yeshivos and day schools. Protests and rallies are understandable. But to burn masks? Regardless of protestors’ intentions, middle America will hear the message, “We will infect you, and you can’t stop us.” The klal should have been sending exactly the opposite message.

The US is not Israel. Americans–the real ones, not NYC liberals–think and act differently. This will not go in the desired direction.

To add to my comment, We all believe that only Hashem can take away the virus. No masks or quarantining will kill this virus. The curve was flattened and that’s the most we can achieve. Time to move on and no governor will abuse us!

The reason The Governor and the Mayor have the Chutzpah, to even dare, to try to do this, is because we never took off the gloves, to give them what they deserved, till now.

Why didn’t we avenge the Jewish Blood which they spilled till now in the Nursing Homes.

The Governor and the Mayor think that ‘Old people’s Lives don’t matter’ in the nursing homes and that the Jewish Leadership will not avenge their Murder, by the Mayor and the Governor.

But till now we never stood up for the Dmey Achicha Tzoakin Eilecha Min Haadama. Instead we made “deals” under the table to hush up their murdererous acts.

It’s time to take off the gloves and give them the prison term which they earned.

We need to initiate Civil Law-Suits, as well as Federal Criminal Charges, against them, for their vialotion of our Civil Rights, and get Coumo and Deblasio arrested and charged, in Federal Court, Charged with Murder, for the deaths of thousands in NYC and NY State Nursing Homes.

ordering the mask wearing is ILLEGAL and it is a worthless stupidity. So is closing schools and shuls. They need a warrant to even go in and cannot produce any. All the peop;e getting it are the ones taht were super quarantined and noe that they are “out” they caught the virus. FOCUS ON GIVING MEDICINES AS WELL AS LETTING ADVOCATES OR FAMILY BE WITH PATIENTS. THEY ARE DOING ANYTHING THE WANT IN THE HOSPITALS WITH INCENTIVES TO INTUBATE AND MAKE SURE THEY MAKE MONEY. Heshy Tischler radio host and local celebrity represents no one. When he ran for City Council he got 400 votes. His ranting and following ambulances on Yom Tov accomplishes nothing. He has no expertise in infectious diseases and is a building expediter not a medical professional. An empty kettle makes the most noise.

It just doesn’t work. There is no good study to back up the claims that it helps at all, whatsoever.

My thoughts are, the average family size in the orthodox community is probably almost double the general population. The fact that we have higher numbers is very misleading. We very possibly have lower rates if you Look at amount of family units infected not by amount of people

The last 2500 years where ever we the Jews lived we were killed, expelled and violated. We never fought back, or even tried to make a statement. Hashem must be with us. We must make a statement. We must do it with out acting like thugs. We must do it peacefully. We also must be grateful that the NYPD does not act like the isrealie police. What can be easier than to wear a mask? And why would anyone with common sense not obey the guidelines for social distancing. The behavior exhibited by our brethren is disturbing to say the least. Are we not commanded by H-shem to care for ourselves?

These protests, while on one level are about the restrictions, on another level they are politics. Trump vs the Democrats. If you are not sure, the people cheering this on are almost all ardent Trump supporters whereas those not supporting these protests are Democrats. In other words be careful about becoming political pawns. Never seems to work out well. I think too many are focused on Wins and ignore the larger long-term picture. Not unlike the refusal by so many to make any effort to wear masks or do some social distancing in the last month, when it was known there were rising cases.
