As has been widely reported, last week a judge vacated the convictions and called for a new trial–a huge victory for Rabbi Eisemann and Lee Vartan, his brilliant and devoted lawyer.

Today Mr. Vartan explains how he persuaded the judge to vacate the convictions, and why the claims against the Rabbi were essentially fabricated. In addition, he describes his personal experience visiting SCHI, and his admiration of Rabbi Eisemann’s immense talent, positive attitude, and devotion to his yeshiva.

“There is no evidence of any wrong doing by Rabbi Eisemann that I have seen in my 5 years on this case….Thus was a slipshod investigation, one of the worst investigations and prosecutions that I’ve ever seen.”

Rabbi Eisenmann is just incredible…in all ways. He has never [for] a day been stressed about this case. He has always been focused on the school and the foundation…I’ve been to the school, when he walks by the children they light up, he has this way with the children that’s truly remarkable.

“The lead detective [for the state] said if private dollars were use there was no crime. The prosecutor said the same thing…So how was it that no one checked if there were private funds?”

“There is no evidence that R’ Eisemann owed any money to the foundation. There was no check or loan. In fact the foundation owed him $350k. But even more incredible, the only testimony about the “write-down” was from the state’s own detective who was interpreting records that he had no knowledge of, and two of the state’s own witnesses said [the detective’s interpretations] were wrong.”

For all practical purposes though he’s been jailed all this time. It’s been about 5 years of h_ _l for him and his family.

This case is travisty. It shows how America is a dumb country who just follows the “law” to whatever advantage works for the prosector. There is no moral values involved. That first judge who handed down an extremely lite sentence is one of the few that gets it. People do get tempted and maybe make small mistakes. But if its small, can be repaid back and overall the guy is a good man have compassion. The prosecutors only have compassion on people of color because its the “in thing”. But the influnteial white dude lock him up. Its so mean and nasty. Cosby is out in a technicality but this guy needs to sit? Gimme a break. Phineas, the system is corrupt and lacks nay moral bearing.

Way too early to celebrate. Another trial with a jury of his “peers” means they get another crack at the Jew.
