Former Israeli Chief Justice: No Compromise On Judicial Appointments Committee

JERUSALEM (VINnews) — Former Supreme Court President Dorit Beinisch claimed that there is no room to compromise on the government’s planned judicial reforms, which she termed a “regime coup.”

“Compromise on what? On these bills? No. In my opinion, there are no two sides here. There are things which they want to be passed in legislation and should be passed, but not everything,” Beinisch said, according to an Arutz Sheva report.

“The real and most difficult bone of contention is the way judges are appointed,” she said. “Because this would be the politicization of the court. The idea of the proposal to actually exclude the influence of the judges from the selection is something I cannot accept. It’s not legitimate. It’s not that the judges appoint themselves, it’s that you have to take everything into consideration.”

Knesset Constitution Committee chairman MK Simcha Rothman responded on Twitter: “The cat is out of the bag. Human rights? Not a big deal. The Knesset will legislate? Let it legislate. The appointment of judges? This is the main issue for her, that they continue to appoint their friends and associates.”

He added that as long as the current system for appointing judges remains unchanged, democracy will remain a “joke” in the State of Israel. “In the end, Beinisch will decide everything. This is what the elections were about.”

Currently, Israeli Supreme Court justices are chosen by a nine-member committee, which includes two sitting Supreme Court justices as well as the Supreme Court head, two members of the Israel Bar Association, two ministers, and two MKs. This gives the judicial branch preference over who is selected to the court, unlike in the US where the President selects the Supreme Court justices and the Senate confirms the selection.

Under the proposed judicial reforms of Justice Minister Yariv Levin, the committee would be reorganized to grant the Knesset greater sway in the selection of judges, with the Bar Association members replaced with two additional elected officials, who will be determined by the Justice Minister.

In the U.S., judges, including Supreme Court justices, have been appointed by the President and confirmed by the Senate since 1789. I guess we are not a democracy.
