Israeli Family Court Judge Refuses To Allow 17-Yr-Old To Wed Pregnant Girlfriend

JERUSALEM (VINnews) — The Israeli Northern Region Family Court rejected an unusual request by a minor who is three months short of his 18th birthday and wished to wed his girlfriend, who is pregnant with their first child.

Judge Avivit Nahmias decided against the wedding despite the support of both families and the strong wish of the couple to tie the knot between them.

The youth had submitted his request after his girlfriend became pregnant unexpectedly. The two, who are both working, want to rent an apartment after their wedding. The youth claimed that he is old enough to appreciate the responsibility of marriage and that both sets of parents approved of the marriage. He said that he had studied in a yeshiva high school and was currently working in a solar electricity company.

The boy’s father expressed cautious support for his son, although he admitted that the wedding was taking place prematurely. He stressed that his son was a responsible mature person and added that he would help him financially if required.

The Attorney-General rejected the youth’s request, claiming that there were no special circumstances allowing a wedding at this age. She claimed that the wish to get married stemmed from the pregnancy and not from considerations for the good of the youth.

The judge agreed, stating that “I didn’t get the impression that the minor understood the meaning of getting married and having to provide a livelihood at his young age.” She added that the minor and his fiancee had not dealt with difficulties in life and stressed that the pregnancy was not a reason to allow the wedding. Judge Nahmias added that she hoped the couple would remain together and marry after they were 18.

So she wants them to get married in three months, but doesn’t think that they’re prepared to get married now. Sounds like she’s just awful at either applying the law, understanding people, or both.

II they were members of the Haredi community this would never have got to the secular court system. They would have got married with a Rav who was prepared to marry them now and sign the papers in three months time. Happens often, admittedly not because the girl is pregnant, but simply because this is what the families want.

The whole western world now does common law marriages. As such, this ruling should be of no significance nor impact the couple in any way other than to defer the ceremony itself for a few months. Someone wanted the court to rush the process so that when the child is born, the parents could say they’re married vs merely together.

Seems to me that she is at early stage of pregnancy, and wishes a quick wedding so as to have the baby “early” at 7 months. I’ll be “Don lchaf zchus” that the Government is legitimately concerned that the wedding is being forced on them, and that in reality, without the pressure they wouldn’t get married. But it’s also possible that the Govt wants to embarrass the Daatim to show that they’re not better than the Chilonim.

Perhaps the test of the relationship is the ability to focus on the wedding in three months time and make the necessary arrangements and preparations, both material and spiritual. It’s far from ideal that pregnancy creates the imperative to get married. But now its too late to backpedal. The judge obviously feels that the couple and their respective families foster commitment and responsibility to help guarantee a stable future for the children.
