Beis Din Rules: No Flaw In Conduct Of Satmar Community Regarding Shabbos In Meron

    JERUSALEM (VINnews) — A dramatic ruling was issued Wednesday night by the Beis Din Tzedek of Bnei Brak regarding the Satmar–Meron guesthouse dispute, in which local guesthouse owners sued the Satmar community and the producer R’ Yaakov Chaim Miller for not informing them in advance that Satmar planned to spend Shabbos in Meron.

    The dispute began after Miller began secretly booking all of the available local guesthouses but not disclosing that the goal was for Satmar chasidim arriving from abroad to accompany the Rebbe for a Shabbos. The guesthouse owners claimed that this constituted a deception and that the prices would have been different for an organized group arriving from abroad.

    The issue, which was first reported on the B’Chadrei Chareidim website, was widely discussed in batei midrash and kollelim across Israel and around the world.

    At the end of the hearing, the Beis Din stated orally that the deal could not and would not be canceled, and that the plaintiffs’ claims had no halachic basis.

    Conclusion of Beis Din: No flaw in conduct of community

    In the dramatic written ruling, the Beis Din rejected the plaintiffs’ arguments one by one, ultimately stating the following:

    “There is no flaw in the conduct of the community and the defendants. There is no reason to expect the public or its administrators to publicize their plans and thereby cause an increase in market prices, especially when such disclosure usually leads to unfair price hikes. They are entitled to act wisely to obtain lodging at reasonable prices.”

    Rabbinic advocate Rabbi Chaim Gerlitz, who represented the Satmar community and the production company, summarized the matter from his perspective in a conversation with B’Chadrei Chareidim:

    “From the outset, the plaintiffs attempted to create an uproar over nothing, to the point that the matter was already publicized in the media as if my client had carried out some sort of ‘sting operation,’ Heaven forbid.”

    “My client and its director, R’ Yaakov Chaim Miller, well-known from the major events they have produced in the Charedi community over the past two decades, are recognized as a symbol of integrity and fairness. Unfortunately, some attempted through various publications to cast aspersions on their work.”

    “However, the honorable Beis Din stated its position clearly and decisively, determining that there was no flaw whatsoever in their conduct and even found it appropriate to praise their prudent management.”

    So they admit that they would have raised the prices for a group so that they can make more money?!? What happened to halocha of Ona’a?

    I guess they felt it doesn’t apply but clearly it does.

    IT is a well know fact in the lodging industry that prices are raised to extremly high rates during special events, sometimes as much triple the normal price. since hotels are not at 100% occupancy during most of the year, this balances out the viability of the hotel. It is supply and demand. Is it fair that a car dealer add a sticker to an in demand car? Sometimes as much as $5000 over and above the MSRP. Again Supply & Demand! If the Meron guesthouses did not see that something was going on with all the advance bookings, they were asleep at the wheel. And the Bais Din ruled accordingly.

    So all the guesthouse owners accomplished is that they now revealed to the whole world that they’re greedy – and proud of it! I’m not even sure loshon hora or motzei shem ra applies to them anymore.

    I once worked for a “wholesale travel” firm in Chicago, that was able to get LOWER PRICES for hotels and airlines by purchasing for large groups. They then passed on the savings (based on what is known as “economy of scale”) to individual purchasers. Based on this, Satmar should sue for not allowing them to purchase “en masse” and benefit from lower-priced “group rates” as is (or was) standard business practice, in free markets all over the world. Even in Israeli courts, there is a law against not discriminating against Haredim; and that should extend to not exploiting them with higher prices, when they visit Holy Sites.

    Now I hope Satmar can focus on important issues such as the plague of Tuna bagels and checked out chasidim in the midst. I mean the ones that are frum just not interested. Yes OTD also but that’s not my primary focus here. What should they do
    1) work on the them at 14. When you see a good boy (not just an otd) who is just less interested or not holding by following the system, create a special mesifta for them. In litfish circles we call it a gimmel mesifta. While the main HS sticks to its mesora of no secular studies, maybe the gimmel one has a little bit in a kosher way. Maybe they even play ball too? Teach them they are part even if they aren’t the most hiesa chasdim.
    2) open a Waterbury and MOE for the OTD
    3) for adults, get them a ruv that doesn’t think it’s beneath him to lead a kehila where women drive or don’t wear a shpitzel. He should be charismatic and give his kehila a cheshek in yiddishkiet. Maybe it’s a chasdish version of KMH or mordys or Scheniers?
    4) set up a few Rabbi Eli stefansky’s yes maybe on the internet too.

    satmar won this din torah but they can forget about doing this sort of thing again. AND they probably ruined the playing field for other groups as well.
