New York – A Queens man was cleared last Friday when prosecutors dropped false assault charges filed against him by his estranged son-in-law, who actually beat himself up.

“The case was factually unsustainable based on the complaint’s lack of credibility,” said Assistant District Attorney Barry Frankenstein about the bogus charges that were filed by Robert Klein against his father-in-law, Brian Hirshman.
Klein, who is going through a bitter divorce battle, claimed Hirshman and other men robbed, attacked, tied up, blindfolded and forced him to recite a rabbi-sanctioned divorce — known as a “get.”
Klein, 25, recanted all his tales and even admitted that he caused the injuries to his head and face, prosecutors said.
Hirshman, 52, made $25,000 bail for the assault and robbery charges. The judge also issued an order of a protection for his daughter and grandchild, who Klein claimed were present for the attack.
“This is is a sad case that shouldn’t have been filed in the first place,” said Hirshman’s high-powered attorney, Benjamin Brafman.
Klein was arrested on May 19 for falsifying a police report and other charges when investigations discovered that his Blackberry cell phone was never stole during the alleged attack a week prior.
“The DA’s office did a thorough, intelligent investigation and in a timely fashion.”
The order of protection was vacated and Hirshman’s record was sealed.
