    Borough Park, Brooklyn, NY – The saying that good walls make good neighbors apparently doesn't apply to one Boro Park couple.
    With a court-ordered wall dividing their marital home, the pair are fighting it out in front of a jury because he refuses to give her a divorce.

    Millionaire Simon Taub, 58, got the green light last year from the Appellate Division to use Sheetrock to separate the Borough Park home he once shared with Chana Taub, 57, his wife of 21 years, into his-and-her halves, as was reported here on Vos Iz Neias.

    Last week, Chana began trying to convince a Brooklyn jury to grant her a divorce – armed with a broken phone, treadmill and TV remote she said he wielded as weapons against her. "It was a very beautiful phone," the mother of four told a rapt jury, showing a cordless headset, the battery dangling from a wire. "Mr. Taub threw it at me. It hit the wall behind me. He has a very violent temper." "Very often, he tells me he's going to hurt me, he's going to poison me," she claimed, testifying he forced her to watch television TV shows depicting husbands killing their wives.
    Although most divorces are decided by judges, Chana Taub sought a jury trial because she said she thought she would get a fairer hearing.

    But he won't let her out of the marriage. Simon Taub said he doesn't agree with the divorce because he did nothing wrong.
    "He's not going to allow her to smear his name with claims that are totally untrue," said his attorney, Abe Konstam. "That's why he's fighting."

    Chana said she has spent hundreds of thousands of dollars fighting her husband, who made his fortune in real estate and manufacturing sweaters, to force him to give her "equitable distribution" of their millions in assets.

    The eldest son of the couple refused to take the stand after his dad came into court with a cadre of male relatives.

    Avraham Taub, 21, was expected to relate in Brooklyn Supreme Court the abuse his father, Simon Taub, allegedly inflicted on his mother, Chana.
    Chana Taub’s attorneys told the judge that Avraham was too intimidated by the relatives’ presence to testify.
    Instead, his younger brother Alexander, 20, took the stand, saying his father would curse out his mother and hurled a TV remote, a Rolodex and a dollhouse at her. [NY Daily News]

    I was one of the jurors on this trial. Although We jurors did not contest Mrs. Taub’s allegations against Mr. Taub, we did find it difficult to grant the divorce because of NYS laws that state that there must be grounds for a divorce, backed by a proponderance of the evidence.

    Our decision was based on the fact that Chana Taub failed to provide resolute evidence that Simon Taub was indeed an abusive man. We found it ironic that the couple did not have any reservations about dragging in the children, smearing family members and acting irresponsibly throughout the matter as if it were not a serious issue.

    Had Mrs. Taub produced compelling evidence in the form of police reports detailing complaints of abuse, or at least photographs of any bruises or marks on her body that portrayed her allegations, this jury would have swung in her favor in a heartbeat.

    We followed the judge’s orders on how to consider the allegations and at the same time keeping in mind the laws of this state. Mrs. Taub had a shaky divorce suit against her husband and the lack of evidence unfortunately caused us to deny the request for divorce. There were also inconcistancies in her testimony that became apparently vulnerable to attack by Mr. Taub’s lawyer.

    Not that she will not get the divorce, Simon Taub has already initiated such action against his wife(Hopefully they will settle before having another jury suffer such a sad trial).

    In the end, no one won. Simon Taub now has the ball in his court to act responsibly as a husband and father in forming a solution for his family. The only obvious solution is to have a fair divorce without having further humiliation inflicted upon either party. It was dispicable to see the children dragged into this case and the uneasiness was noted in all their faces.

    It’s sad that this had to play out like a circus, it was a waste of everyone’s time and in the future such cases are better off if they are left to be decided by a judge.

    Baruch Hashem. She tried to circumvent Beis Dina and lost every step of the way. That alone is a kiddush hashem if one yid refrains from using a secular court.

    She threw the dice and asked for a secular judge and he ruled against her every step of the way. So she asked for a jury instead of a judge (highly unusual in a divorce case) and still lost. Sometimes the truth is so obvious to see, even in these courts.

    Not sure why anyone is making such a big deal about him hurling a rolodex at her. He probably got a Palm or some else more appropriate for this day and age and no longer needed a rolodex. Also, isn’t she a bit too old to be playing with dollhouses to making a big deal about him throwing the dollhouse? Now the TV remove – that is an issue I can understand. Don’t know what would have possessed him to throw that. Besides, which man ever lets his wife get hold of the TV remote? He must be completely deranged.

    On the other hand i feel even worse for you guys if the RBS”O judges you with the same natiness you have heaped on these two people.

    You don’t know what went on behind closed doors. he may be an ax murderer and she may be Liona Helmsley’s inspiration but he could also be a lamed vov’nik and she may be Sarah Schneir re-incarnated.

    Ruining them, how? When he threw stuff at her he wasn’t ruining them? Get a life! This is a terrible situation stop the garbage posts that come from people. Like, she is ruining them, or she is a meshugene etc..

    STOP! STOP! STOP! – Nobody could imagine the pain and suffering R”L the children are going thru. Why does everybody have to make comments if they don’t even know five percent of the story. For whatever reason it hit the media, or for whatever reason the Mr. or the Mrs. is acting the way they are, there is no reason to bashmutza the family more. EVERYBODY has there own problems. and the way YOU forget about them, is YOU get into OTHER PEOPLES problems, hoping you will forget about your own.     These people are both idiots. If in a case where both parties don’t listen to a bais din and have to use the secular courts, it still should be a private affair, not spalshed all over the media. There is a severe breach of tznius here in this public airing of their dirty laundry.

    This should have been adjudicated in Beis Bin based upon halacha. NOT in secular court baed upon secular law. Of course she has more benefits in the goyish courts with secular law. So she went there. When that failed, she went on a media blitz.

    oh everyone! Stop calling her a gold-digger. They were married for over 20 years. Shouldn’t she get something? She doesn’t want to live with him! Thats it! He should give her a GET and move on with his life. They should sell the house and split it. What, she didn’t help out over twenty years? She took care of the domestic part of the relationship and enabled him to work his kishkes off so that he could be a rich wanna be with little class. If he were half the man that people here claim he is he would give the GET move out and move on with his life regardless of who wanted the devorce first.

    Is he afraid that he won’t have money to pay for challos for shabbos if they go through the normal split process? Come on, give us all a break and both of them should jump out a window.     It is terrible to have a private matter as a divorce out in the open like airing your dirty laundry. I don’t why the husband built a wall in the middle of his house to begin with. one or the other should have moved out. Their kids must be all messed up because of this. They’re probably both self centered people and don’t care about what others think about them. They have no modesty, airing this all in public. Who cares if she had 299 or 300 pairs of shoes. It must take a long time getting dressed in the morning trying to decide which pair of shoes to wear. Who does she think she is anyway -Imelda Marcos?

    The chiddush here is that he actually got half the house. In this corrupt American so-called ”Justice” system the deck is stacked against a husband in a divorce case. The wife typically gets everything. The house, the kids, and half his fortune. In this case she was such a chazer, she lost all her motions in court, and even only got ‘half the house’, something usually the courts give to the wife.

    To anonymous 11:48, in the Darndivorce.com article, the husband conceded that she did not have 300 shoes, so your trying to indicate that she may have had 300 shoes is motzi shem ra. Perhaps you didn’t read the whol article, but the end of the article reports that the husband conceded that it may have been 299 pairs.

    I don’t know the truth or not however I did notice this.

    At Darndivorce.com she denies she has 300 shoes and claims she doesn’t care.
    At NY Daily News she is concerned about wether she will get her 300 shoes back.

    Someone who is so manipulative, and is attempting to use the media to her advantage, and contradicts herself, to me is someone who is unstable, and obviously has an agenda.

    He has never gone to the media, and always had a consistent story. She has always run to the media, and flip-flopped.

    By going to the press, she is saying that she wants the public to judge. So as per her wishes, let the public be the jury.

    All I know is that in these cases its never so poshut like black and white…its almost always what he said and she said and the thruth is somewhere in the middle and that’s why halacha is always in favor of peshora so that neither party comes away bitter. Unlike the secular courts where winner (with the higher priced lawyer) takes all….
    Unfortunately, when egos get in the way, there is a big chilul Hashem and only the lawyers end up rich….

    Did you see her photo on the D.N. site? She mamesh looks like a gold-digger. It is reeking from her face (see her eyes.) Did you also notice the American flag pin on her suit? I wonder why? Subtle jury influence.

    Whoever heard of taking a divorce case to a jury? It is extremely rare. Yet she insisted on it. Airing all her dirty laundry and loshon hora. Whatever happened to bais din? I guess it didn’t work out for her, so halacha be damned.
