Israel – An indictment has been filed with the Jerusalem District Court Sunday against a Kiryat Arba resident charged with attempted murder of a Palestinian terrorist who stabbed his wife at a gas station in November 2009. According to the indictment, the defendant, David Mizrahi, 56, tried to run over the Palestinian who was laid upon the ground after being shot by the IDF.

The indictment, filed by attorney Zohar Giat, states that the Palestinian, Waseem Maswadi arrived at the gas station near the entrance to Kiryat Arba carrying a knife and an axe with the intention of carrying out a terrorist attack. He then went into the gas station store and stabbed Tamar Mizrahi in the throat with his knife before going on to stab Moshe Salfati in the back of his head.
The gas station security guard fired at Maswadi – who continued running for 20 meters before falling to the ground. At this point, three soldiers who had been nearby, arrived at the scene after hearing the gun fire.
Maswadi got up and hurled himself at the soldiers with his knife screaming “Allahu Akbar”. In response, the soldiers shot him in legs, and he fell on the spot.
The incident soon drew in curious bystanders, including Mizrahi. According to the indictment, Mizrahi arrived at the scene with the intent to kill the terrorist. At first, Mizrahi attacked one of the victims after mistaking him for the terrorist. When he realized his mistake and noticed Maswadi lying on the middle of the road, he began to drive in his direction in order to run him over.
The prosecution stated that Mizrahi is accused of confirming the identity of the terrorist with the soldiers before committing the crime and then pushing aside the soldiers as he began driving over the terrorist repeatedly – to make sure he was dead.
People at the scene tried to stop the defendant, who was finally stopped when large numbers of military and police forces arrived to clear the scene and evacuate the victims. Maswadi was indicted for carrying out a terrorist attack.
So what did he do wrong?????
Indicted?! What?! They should give him a medal for ridding our society from scum.
The sick leftists are at it again, crucifying a hero, and glorifying a monster, may these lawyers against him suffer the same fate as the terrorist
Good for him!!! I would have done the same to the terrorist who stabbed my wife. To all the liberals out there, I know there will be an outcry on behalf of the “poor” terrorist. But this is the only language these animals understand.

Any husband who does NOT pursue an attacker who stabs his wife in the head should be arrested. Not the other way around

In America the use of extreme force in apprehending a bad guy can get you indicted. If you shoot a guy once he is down you will always get indicted.
The truly sick thing is that it is more than possible that this guy will do more time than his wifes attacker.
this was clearly not an act of self defense, and as such one may not take matters in his own hands.

you need to put your personal feelings aside and look at this with a straight mindset.
if we’d have such behavior going on in society, what would happen is, that lay people will come to conclusions without proper investigation. the result would be that, for example, one killing someone else’s wife by mistake, would then be killed by her husband who might think that it was done intentionally.
in no way am i pertaining to say that this arab made a mistake. i’m merely pointing out why self revenge isn’t an option.
I’m sure that the defendant in this case will eventually be acquitted, or at the most will receive a very light sentence.
While it may have been legally wrong for repeatedly running the terrorist over, morally, it was the right thing to do. The Talmud teaches us that if someone comes to kill you, to kill him first. Unfortunately, during war time, many of our soldiers were killed, since they didn’t finish off the enemy, who was purportedly deceased on the ground. The Japanese Imperial Army during WW2,often would have its soldiers faking death. When our brave GI’s would go to see who was still alive, the Japanese would attack them with grenades and knives. It is better to be safe than sorry. As an NYCPD cop told me many years ago “I tell all of the new recruits, that at least your relatives can visit you in jail; it is better than an Inspector’s funeral”.
However the criminal case turns out, they should certainly revoke his drivers license. He drove over the guy 3 times and he still lived!
Of course we all understand his emotions. If someone stabbed my wife getting him would be the first thing on my mind after making sure she was in no further danger.
Charging him was also the right thing to do. Absolutely. No doubt about it.
1) He attacked an innocent person. When you learn defensive shooting they tell you “You are responsible for every bullet that comes out of that gun.” If you harm an innocent you have committed a crime. “I couldn’t be bothered to figure out if he was the one” is not a defense.
2) The suspect was already in custody. He was the IDF and the police’s responsibility, not the citizen’s.
3) Most important, the suspect was no longer a threat. In every legal code based on European law, which includes Israel’s, your right to self defense ends the moment there is no longer a threat. The guy was on the ground, shot through the legs and unable to hurt anyone. Time for the Law to deal with him, not a lynch mob of one.

It wasn’t an act of self-defense, it was an act of *revenge*.
