Florida Attorney General: Open Carry Now Legal Statewide

    ORLANDO, Fla. – Florida Attorney General James Uthmeier announced Monday that “open carry is the law of the state” following a key appeals court ruling.

    In a post on X, Uthmeier said he was issuing guidance to prosecutors and police after the 1st District Court of Appeal struck down the state’s open carry ban, declaring it unconstitutional under the Second Amendment.


    The case stemmed from the 2022 arrest of Stanley McDaniels in Pensacola, who was carrying a holstered pistol and a copy of the U.S. Constitution at a downtown intersection. A three-judge panel vacated his conviction, writing that Florida’s ban was inconsistent with the nation’s “historical tradition of firearm regulation.”

    Gov. Ron DeSantis welcomed the ruling, reiterating his support for legislation that would enshrine open carry into state law.

    I expect to see many here in Florida open carrying handguns and long guns in and around Shuls, especially on Yom Tov. This is a very welcome show of force ( although open/ visible, but non threatening). This timing I believe will be instrumental in keeping our families and friends safe.

    America the laughing stock of the world when it comes to shootings. Australia banned guns 30 years ago and basically there hasn’t been a single mass shooting since.
