The Canadian Press reports that Judge Lynda Templeton still has “grave” concerns over the welfare of the children in the ultra-Orthodox sect, but stated that sending them back to Quebec would create even more instability in their lives that could have severe psychological consequences.
The judge’s ruling overturns a decision made earlier this year that Ontario should enforce a Quebec court order in which the children would be placed in foster care.
Seven children are currently in foster care in Ontario. Six children and two adults fled to Guatemala in March.
The sect has been involved in an ongoing investigation regarding allegations of underage marriages, lack of basic hygiene, and education concerns. They fled Quebec late last year to avoid a court date regarding the child protection case, a tactic Templeton says will not continue to work.
Lev Tahor have denied all allegations of abuse and underage marriage, and explain that the children are given a religious education.
The Chatham children’s aid society will continue investigating the families and the provincial court will now decide if the children need continuing protection.
