Quebec High Court Overturns Historic Get Ruling

0

The Quebec Court of Appeal has overturned a precedent-setting order that a man pay damages to his ex-wife for withholding a get despite having signed an agreement to appear before a Montreal rabbinical court immediately after receiving a provisional civil divorce.
The three judges, ruled unanimously that Superior Court justice Israel Mass was wrong 2 1/2 years ago when he decided that the defendant, Jason Marcovitz, entered into a contract that is civilly enforceable, despite its religious nature.

The higher court says the federal Divorce Act does not give courts jurisdiction to require the issuance of a get, the Jewish religious divorce, no matter what the divorcing parties have consented to, because courts don’t have the right to enforce a matter of religious obligation. It also ruled that the 1990 amendment to the act requiring spouses to remove barriers to the other’s religious remarriage before a civil divorce is granted was irrelevant in this case because of a legal technicality.

Town of Woodbury and Kiryas Yoel’s land issues

0

Woodbury — Town officials have spent more than $430,000 so far on planning consultants and lawyers to develop a new comprehensive plan and contend with a host of land-use issues that have cropped up since ACE Farm was sold last year.
The issues came fast and furious: a looming land tussle with neighboring Kiryas Yoel; the decision by town leaders to update Woodbury’s zoning; an attempt to protect the town by turning most of it into a village.
These and other activities – some still in progress – have been steadily registering as billable hours for two outside firms working for Woodbury since the land uproar arose last year.
The legal bills will only grow higher. Lawyers for Woodbury and Vaad Hakiryah of Kiryas Yoel are fighting in court over the Village of Woodbury petition and haven’t even gotten yet to the substance of Vaad Hakiryah’s objections.
Meanwhile, an even bigger court battle is brewing once Vaad Hakiryah announces its plans for ACE Farm and hundreds of other acres of Chasidic-owned land outside Kiryas Yoel.
