Karben, who declined to testify, was before the judge resulting from his arrest on Brick Church Road on Jan. 30. as was reported here on Vin News.

Police responded to a call that a car had hit a pole and was blocking the road. When they got there, police found a damaged car about a quarter mile away that had severe front-end damage.

Ramapo police officers Robert Collins and Michael Gannon testified that when they talked with Karben, he had slurred speech and his eyes were glassy and red.

Collns said Karben failed three field-sobriety tests: the nine-step walk-and-turn, nose touch and the one-legged stand. Collins testified that he had to explain the tests several times to Karben.

Karben was asked to take Data Master test three separate times and each time Karben refused.

Doynow sustained the charges against Karben, at which point his driver's license and driving privileges in New York were revoked.

"We're confident if this gets to court, he will be vindicated," Picola said. [Journal News]
