    Lakewood, NJ – Two sides in a lengthy dispute about an ad hoc synagogue in a senior community are taking the matter to court.

    Superior Court Judge Frank A. Buczynski Jr. in Toms River will hear the lawsuit brought by A Country Place contending that Orthodox Jewish homeowner Anna Kahan, is ignoring the private community’s bylaws by renovating and using her condominium for worship services.

    Residents of the age-restricted, 376-unit community began complaining about the dozens of people gathering for weekend services at a home on Azalea Court that had been renovated to accommodate them.

    Susan Warner, 68, of Lake Park Boulevard, maintains that the value of her condo has decreased from $160,000 to $62,500, a decline she blames largely on the makeshift synagogue.

    “Traditional Jews don’t drive on the Sabbath and so need a synagogue within walking distance,” Rabbi Moshe Zev Weisberg of the council of Jewish leaders, the Vaad said.

    The lawsuit is also seeking payment of $5,000 in fines from Kahan, who it claims resides permanently in Brooklyn.

    Superior Court Judge Frank A. Buczynski Jr. in Toms River put a temporary restraining order on the condominium, since it was unclear whether a wall removed from the unit was a load-bearing wall.
    He has asked lawyers from both sides to arrange for an independent engineer to inspect the condo. The case should resume July 17. [APP]

    If a person understands building, it takes about two minutes to determine if a wall was load bearing. OR you could look at the orignal bulding plans. Duh.

    Can, or do, condominium bylaws prohibit a shiva minyan in such a unit?

    If no other unit has ever been removed part of a wall, then is the only issue that a minyan regularly visits the unit?

    For $62K maybe this shul could utilize the neighbor’s unit as a balcony area or a hospitality area or parsonage for the shul!

    Prices EVERYWHERE have dropped drastically. But I doubt it dropped that much just because of the synagogue. If it dropped that much that fast, something must be wrong with it. Or she’s just playing the number game for pity.

    I refuse to believe the price dropped that much. She probably has other things wrong with the place that is bringing it down.

    Let her sell to inzer mentshin and she could see how much she will MAKE on it!
