New York – The New York Court of Appeals says prison officials can force feed an inmate on a hunger strike to prevent his death, finding that doesn’t violate his constitutional right to refuse medical treatment.

The Court of Appeals, divided 4-2, notes inmate Leroy Dorsey began hunger strikes in 2010, dropping from 241 to 147 pounds, claiming he wanted to transfer and air grievances about his treatment and insisting he wasn’t suicidal.
Officials got court permission to insert a stomach tube. He resumed eating and appealed that court order.
The majority says Dorsey was killing himself and officials properly balanced his rights against “legitimate” prison interests, including avoiding disruption from his death or copycats of his “strong-arm” tactic to get what he wanted.
