Jewish School Sues Miami Beach Edan Rock Hotel For $2.3 Million Refund After Canceling Passover Vacation For 1,200

MIAMI (JTA) – A Jewish day school in New York City has sued a Miami Beach hotel for a refund after canceling a 10-night Passover vacation due to the coronavirus crisis.

Students, parents and staff of the Magen David Yeshivah in Brooklyn had rented 621 rooms for about 1,200 guests for the April program at the Eden Roc hotel. The down payment for the vacation was $2.3 million.

The school filed its lawsuit in Miami-Dade Circuit Court, the Miami Herald reported Tuesday, on the basis of a clause in the contract that said the reservation could be canceled in the event of a “disease outbreak.” The hotel is demanding that the event be rescheduled for later in the year or proceed as scheduled.

Magen David canceled the event by March 18, the newspaper reported, and two days later New Yorkers were ordered to remain in their homes, with travel forbidden. Meanwhile, Miami Beach ordered hotels to close and cancel reservations.

The school first held a Passover event in 2018, and returned in 2019, according to the report, after which it signed a three-year contract with the hotel.

Magen David runs from early childhood to high school and is “rooted in the Sephardic tradition,” according to the school’s website.

What am I missing here? On what basis are they refusing to refund the deposot if hotels were ordered to cancel reservations? What does the hotel think?

I cannot imagine why a lawsuit is required. Hotel chains must be handing out refunds with a shovel. I wonder why they are being difficult on this case.

Ay Way. The best thing happened . Maybe they will think next time what to do with 2.3 m. How about it buys 200 ventilators and could save many Jewish life

2.3 is just the deposit the bill annually is way more .. tzedaka question is out of context , firtly most yidden who have money give & give .. its very difficult to be a rich frum guy & not give from the social angle
i am a regular working guy yet the torah allows wealthy people to live a diff lifestyle ( within reason) yes for him its ok for me its not
the problem w pesach hotels is not the money , it is that many times the atmosphere is the opposite of yetzias mitzrayim although some aspects of menucha are there in a hotel ( if you are reading diff hagados and seforim because you DONT have to peel & cook but by n large the gashmius is a shter to the real cheirus
