New Deri Law Set To Pass In Knesset Law Committee But Attorney-General Claims It’s ‘Unconstitutional’

JERUSALEM (VINnews) — In the coming days the Knesset will begin the process of legislating a new “Deri” law which will enable former Interior and Health minister Aryeh Deri to return to his ministerial status.

The law was drawn up by Shas MK Moshe Arbel, submitted by Likud MK Offir Katz, who is the coalition whip and signed by all the members of the coalition. The law states that the court will not be able to exercise judicial veto over the appointment of ministers in the government and to disqualify various ministers in the government.

The law is expected to pass through the various stages of legislation in the coming days, firstly being approved by the committee and then reaching the Knesset plenum for first reading. After this it will be returned to the committee for discussions and then reach the Knesset for its final reading within a month.

The legal reporter of the Yediot Aharonot newspaper, who is closely associated with senior members of the Justice Ministry, reported Sunday that it is generally estimated that Attorney-General Gali Baharav-Miara will establish that the new law is unconstitutional and will recommend the Knesset not to approve it. If the law passes, Baharav-Miara may state that she will not defend it in the Supreme Court if petitions are made against it.

Last week Baharav-Miara told Prime Minister Netanyahu that he is not allowed to have any role in the judicial reforms, as he is in ‘conflict of interests’ due to his ongoing trial. Netanyahu responded, stating that he viewed Baharav-Miara’s view as “unacceptable” and would respond at length to her stated opinion within two weeks.

Despite her continued opposition to the coalition moves and numerous calls from coalition members to fire the Attorney-General [an appointment of former justice minister Gidon Saar], the government has yet to make a move to oust her from her position.

Is this where the religious parties want to take their last stand? Defending a convicted felon? What will they have left to say when Lieberman is in power and puts his convicted friends as ministers? Aizehu Chacham, Haroeh Et Hanolad. These folks would appear to be the opposite of smart.

While I agree with the Judicial Reforms (as the Judiciary has inserted themselves as an unelected branch of the government with Veto powers over the Knesset); there remains 3 problems. 1. There is always the risk of the “oppression of the minority by the majority”; which Israel’s lack of a Constitution leaves no way to protect; & 2. Netanyahu (whom I admire & support, & who is a true Patriot & has been a vehicle that the Ribono shel Oilem has used to advance the State of Israel, the Yidden who live there, as well as Yidden all over the world) is not Lehavdil elef Havdollahs Moishe Rabbeinu, and is biased and enjoys the power. To require a unanimous 15 member Supreme Court to overturn a Knesset decision is not sufficient to “check” Netanyahu & his Government. 3. There has not been sufficient discussion & debate amongst Israeli Citizens to arrive at a conclusion that would allow the citizenry (the 45% who don’t support the current ruling Knesset Coalition) to feel that their voice is being heard on something as integral as a change to the way Israel has evolved over the last 20 years. 4. Insufficient Hasbara has allowed the Liberal Media to paint Netanyahu as a Dictator trying to establish Totalitarian rule (not that different than the Liberals in America painted Trump when he was President).

So the knesset decides not to listen to the courts but the courts can then overule that
. Then there is no democracy left. We need to make it illegal to appeal anyhting to the courts. Just like in roe v wade where our courts said that its up to elected offcials to decide so must the court leave that in israel to elected offcials
