NEW YORK (VINnews) – Manhattan DA Alvin Bragg’s Office filed a motion to dismiss the murder charge against Jose Alba, the bodega worker who fatally stabbed a man who came behind his counter.

The embattled DA faced harsh criticism and public outcry after Mr. Alba faced with first degree murder charges after a 35-year-old violent ex-con, Austin Simon, had attacked him inside the bodega on July 1.
The DA’s office said it had filed a motion in Manhattan Criminal Court to dismiss the case against the 61-year-old bodega worker after a investigation found they couldn’t prove the “defendant was not justified in his use of deadly physical force.”
and thats the way it should be, every store owner should be armed. Make sure you kill the attacker, save the taxpayers the cost of trial and prison.
