EXPLAINER: Will the courts overturn New York’s secular education rules against Yeshivas?

NEW YORK — A lawsuit has been filed by New York’s Yeshivas, led by attorney Avi Schick, against the NYS education department. The yeshivas are asking the courts to overturn the crushing equivalency restrictions which recently passed the Board of Regents.

The yeshivas have 3 main arguments:

1. Religious discrimination

2. The state is overreaching its authority

3. Violation of the state review process (SAPA) (the state received 300K comments opposing the rules, yet failed to respond or change the guidelines)

The Amish successfully overturned similar rules against their community’s education.

It went to the Supreme Court and the court ruled for the Amish.

The Yeshiva lawyers should cite the Amish case as precedent.
