    Postville, IA – A former manager of an Iowa kosher slaughterhouse will be sentenced to 27 years in prison and ordered to pay nearly $31 million restitution when he’s sentenced Tuesday in U.S. District Court.

    Chief U.S. District Court Judge Linda Reade issued a sentencing memorandum Monday outlining the sentence she will impose on Sholom Rubashkin during Tuesday’s hearing in Cedar Rapids. Reade indicated in the document she would not impose a fine.

    A jury found Rubashkin guilty on 86 federal financial fraud charges last fall.

    Rubashkin’s attorney Guy Cook says the sentence is unfair and excessive that that Rubashkin’s conviction and sentencing will be appealed.

    U.S. attorney spokesman Bob Teig declined comment until the sentence is imposed.

    The Hon. Bob Barr announced Monday that Rubashkin will appeal the verdict and the sentence.

    “This sentence is inconsistent with the overwhelming view of the legal community, including six former U.S. attorneys general, who have all said a first-time, non-violent offense does not warrant a multi-decade sentence,” Barr said. “The court’s sentence today is even more than prosecutors asked for, which is a very disturbing development.”

    Rubashkin’s attorneys had asked the court to impose a sentence no greater than 72 months, noting his positive history and character and his extraordinary family circumstances. They emphasized that Rubashkin’s conduct was not done for personal gain, that he did not intend any loss to the bank, and that a 72-month sentence would allow the Bureau of Prisons to place Rubashkin in a facility with experience in effectively and humanely incarcerating observant Jewish inmates.

    Prosecutors, however, recommended 25 years in prison for Rubashkin. The extreme recommendation sparked outrage amongst legal scholars, with more than two dozen former senior Justice Department officials – including six former U.S. attorneys general – criticizing the prosecutors’ recommendation in a letter to Judge Reade. Rubashkin also garnered support from a wide array of political, legal and community leaders, who expressed dismay at the potential for Rubashkin to receive such a harsh sentence.

    “It is heartbreaking to see the judge and the prosecution make an example out of Sholom Rubashkin at the expense of his family and his community,” said his wife, Leah. “What has happened today is inconsistent with the idea of equal justice under the law. All we have asked is that he be treated the same as everyone else.”

    Rubashkin’s sentence is particularly harsh when compared to others convicted of similar crimes. Mark Turkcan, the president of First Bank Mortgage of St. Louis, who misapplied $35 million in loans, resulting in a loss of approximately $25 million, was recently sentenced by a federal judge in Missouri to one year and one day in prison.

    The Rubashkin family and its supporters remain committed to pursuing all avenues towards a fair sentence, including appeal. They continue to call on the Justice Department to investigate the pattern of overzealous prosecution in the Rubashkin case, which included the life sentence recommendation.

    “The way this case was handled may go down in history as a permanent stain on American justice,” said Nathan Lewin, an attorney overseeing Rubashkin’s appeal. “Sholom Rubashkin has been targeted by prosecutors in Iowa from the very beginning, and has been treated unlike other similar defendants. We have asked, and continue to ask, the Justice Department to review the numerous instances of prosecutors stepping outside the bounds of standard and decent conduct in this case.”

    This judge is pathetic! She gave rubashkin 27 years, 2 years more than prosecuters asked for!!!!!!!!!!!!!!!!
    Although she will rot in hell for this, I believe this is the yeshua! Sentence exceeding prosecutions recommendation (which even the prosecutional recomendation of 25 years received criticism, as too harsh from 6 prior ag’s) will be appealed bezh and he won’t be sentenced to a day.
    This judges antisemitism is gonna kill her like helen thomas’s hate killed her. Wth didnt she give 2 years less as prosecuter recomended 25 years? Becuase she and helen thomas’s hate are stronger than their brain!!!!!!

    This is terrible! We need to press Congress to repeal the federal sentencing guidelines and to provide for review of all sentences passed over the recent decades.

    The only good news is that this is much better than a life sentence and he might get out on probation after 15 years. Is this new lawyer the same Bob Barr, the former Congressman from Georgia who left with questions about his personal life and extreme right wing policy positions? Strange choice for new defense counsel. What happened to Nat Lewin et. al.

    it’s a verry sad day for us the jews of the usa.
    this verdict has very little to do with the law, she’s doing what her family members did to Jews for the last 2000 years in golus, we have to daven to hashem, and help the family in any way shape or form. i’m hopping that the supreme court will reverse it.

    Sounds like the judge doesn’t want to accept the fact that he was found innocent on the other charges and is taking it into her own hands to make his sentence longer. B”EH the appeal should be in has favor.

    The conduct of the State of Iowa towards R’ Sholom is in line with the conduct of goyim in general over thousands of years. Chazal say that if the umos haolam would understand the importance of the Beis Hamikdosh to their well-being they would surround it with armies to protect it. Not only ddn’t they do that, they became part of the churban. During the Middle Ages the countries of Europe all saw how ecomically enhanced they became with a Jewish presence, yet periodically would throw the Jews out, resulting in economic ruin for that country. Agriprocessors was the main employer in Postville, bringing millions in economic relief and jobs and taxes to the community. The ingratitude of Iowa is appalling. The viciuosness with which the prosecutors went after him, the egregious nature of the judges, is all amazing. Hopefully R’ Sholom will prevail on appeal to saner judicial authority. Hashem Yazor.

    For all of you who have practiced outright sinas chinam right here and on other blogs, please note that SHE, Linda Reade is the sheliach for you sinah. Know that Hahsem hears and sees everything in your hearts and minds and all the rechilus and loshon horah you spread! Please keep that in mind before you do to someone else what you have done to SMR.

    For all others who daven for SMR, please know that your tefillas will not go unanswered. Please have at least as much bitachon and emunah as SMR has. His case will go to appeal and we must double and triple our efforts of achdus and ahavas yisroel on his behalf. I have coined a new slogan “APPEAL FOR TRUTH AND JUSTICE”

    yup I agree – Reade is going down – that’s a given. Too bad she messed up big time. There is no iota of a sane reason to come down as harsh as she did when for example a bank manager for $35M “booboo” gets 1 year and 1 day just recently..not that SMR was 100% in the right – the punishment and show were just unfairly excessive.
    This one will not go away it seems.
