Brooklyn, NY – Defense Team Says Levi Aron Is No Different Than A DWI Case

APBrooklyn, NY – Fielding questions from the media after Levi Aron’s arraignment this morning, the defense team of Pierre Baile and Jennifer L. McCann suggested that Aron was no different than anyone who committed a moving violation.

    “This case is no different from the DWI’s, the traffic tickets or from other murder cases,” said McCann. “They are defendants. They have rights and we are here to protect them.”

    McCann insisted that, as a defense lawyer, it is her job to defend her clients’ constitutional rights, irrespective of their guilt or innocence.

    Despite the ruling today by Judge Neil Firetog that Aron was competent to stand trial the defense refuses to rule out an insanity defense in the case, pending a full psychiatric evaluation and questions whether Aron would be able to receive a fair trial in Brooklyn.

    “We are going to try this case in that courtroom you just saw,” said McCann. “We are not going to try this case in front of the these cameras.”

    They are right, although its not somthing we want to hear. Aron has the same rights as any other defendant and any effort to restrict those rights could result in him being set free. Even if he is found guilty or enters into a plea agreement, he will still have certain rights. Thats the way our system works.

    I only see there Basile & McCann, where are the 2 others murderer defenders, ‘Shredready’ & ‘Chaim ben Yehuda’ are they off camera, or are they just family members / close friends of Levi Aron?

    You know with this comment they blew it. NO DIFFERENT THAN DWI????? Shame on these 2 low life lawyers , shame on the parents that bore them. Everyone says every criminal needs a lawyer. But, no human being can say such an inhumane statement. SHAME , SHAME. You 2 lawyers will go down in the history books , as the lowest of low!!!

    people must understand everybody has a right to a defense and a good defense. The whole system is based on that the government needs to prove guilt in front of a jury or judge.

    Once we say in this case lets forget that we are going down a very dangerous slope. Let him have his day in court, as we see the evidence is overwhelming.

    We live in a society with rules, many rules protect us from the government power

    and this is one of them.

    For these who disagree just give a little look and see which countries do not have due process and think would you like to live there.

    If Lavi Aron had killed a non-Jewish child, these same people would be raising money for his defense fund and rallying in front of the courthouse to get justice for him.

    Am i the only one who’s wondering who hired these lawyers? Whatever I read so far indicates that the family hired them, so if that’s the case, why doesn’t anyone knock sense into their head? Y do they even wanted him to be defended by such powerful attorneys, let him just get a court-appointed lawyer for legalities. This whole parshah is really making me so upset!

    He has the same rights that any other criminal defendant has – no more, no less. The rights protect all of us, and therefore him, from government lynchings.

    obviously re: the constitution she was technically correct, but the sheer chutzpah and disregard for the community’s feelings just goes to show that it takes an animal to defend one.

    anonymous (comment#1) has been commenting on nearly every thread associated with this topic and is either a wanna be lawyer or somehow connected to the murderer. anonymous- dont ever ever speak for “we” . “that’s not something we want to hear” let’s be very clear- you are seperate from and do not speak for any of us. Here’s what you don’t seem to understand: the law defends citizens to the extent that it attempts to avoid kafka type situations allowing one to face the accuser, the evidence against them and prove thier innocence. the intent of the law is so that innocent people dont get wrongfully accused and can be formally sentenced without any angry mob lynching (which is less cruel actually than some of the stuff other inmates are likely to confront him with in prison). Aron is only protected defacto. He is not part of some sort of protected class of people whos rights you need to stand up for. he’s riding on a law made to protect the innocent and imprison the guilty. he essentially got lucky. Miss mccan lives in moral vertigo and has convinced herself she is somehow a champion of justice, by defending the worst of humannity. she could have easily taken a job for the ada/eeoc

    Is it only me or does that lawyer seem like a total thug? He could not care less about the fact that human emotions are involved. Who gives a hoot if some online website ran a poll of whether he should be executed??
    The only thing i like about this guy is the fact that he seems like a terrible lawyer and is likely to butch of the defense.

    She was not comparing murder and DWI in terms of the severity of the crime and the implication here and elsewhere that McCann was doing so is disingenuous. And stupid.

    What McCann was saying, and she is 100% correct, is that every person, no matter the crime, has a right to a defense. Just like DWIs and traffic tickets, the severity and heinous nature of this crime does not mean that the accused’s rights are forfeited.

    Ans there is a very good reason for that. What of the guy had help? What if the confession was beaten out of him? What if there are more victims? What if someone paid the murderer to do this? What if he had accomplices – shouldn’t they pay too? The chaim yankel streetcorner geniuses on this blog and on every corner in BP THINK they know everything, but the system is smarter than they are.

    The system is adversarial and puts the burden on the People to prove their case lawfully and with the defendant guaranteed a defense precisely so that any questions like these can be vetted through and determined. His confession, the evidence all needs to work inside a court of law and in that regard the defendant is in fact no different than any other.

    POINT to be made: Say what you may but everythings in the words that u say. Mchann may be this Great Defense lawyer she’s making herself to be but a Great Speaker she’s Not. and if she puts her foot in her mouth time and time again then yeah: she will get smack for it. Say what you want…. You don’t EVER compare a murder, especially of such sort, to a DWI! In any which way and no matter what it really means. EVER!!

    she’s yelling fire in a crowded theater to get press. it’s actually a dumb statement Of COURSE dwi and murder offenders all get to have representation- what a very dumb dumb statement. but she knows that putting the two in the same statement will get her attention. don’t give her attention.

    30 is correct. change of venue will not help. I’m thinking hard but can’t come up with a single state in which a jury is more friendly toward kid killers. nope. not gonna help.
