Prosecutors Say Man Who Choked NYC Subway Passenger To Death Will Face Manslaughter Charge

    NEW YORK (AP) — Manhattan prosecutors said Thursday that they will bring criminal charges against a man who used a deadly chokehold on an unruly passenger aboard a New York City subway train, an incident that stirred outrage and debates about the response to mental illness in the nation’s largest transit system.

    Daniel Penny, a 24-year-old U.S. Marine Corps veteran, will be arrested and face a charge of second degree manslaughter, which could carry a jail term of up to 15 years.

    “We cannot provide any additional information until he has been arraigned in Manhattan Criminal Court, which we expect to take place tomorrow,” the Manhattan district attorney’s office said in a statement.

    Who knows how many more people Bragg is now sending to their deaths. To die for liberalism and it ideology.

    Now it is so much less likely that good people will intervene and save others from crime and attackers .

    The liberals send enough people to their deaths and spilled enough blood with bail reform, defund the police and policies that favor the criminal over the victim. Do they really need to spill even more ?

    This is what they want, people should be afraid to defend themselves, their goal is for the criminals to be able to roam around freely with no worries from police or civilians, the message here is for the criminals don’t be afraid that someone will intervene in anything you do we will take care of them if they do.

    Everyone on that train was scared and this guy saved them. He held him down until he stopped being violent, when he was told to stop – he did. So everyone on that train are his witnesses and they would have done the same were they in position to overpower a huge guy.

    He did not kill him. The crazies drug use killed him. Just like George Floyd. Heart failure of a chronic drug addict can easily occur from things thag would otherwise not affect healthy people.     I am a firm believer in the 2nd amendment and the right to self defense and am against any and all gun control but this story I’m torn as to how I feel. In use the force with a firearm to defend yourself you are both legally and morally responsible for every bullet you fire from a gun in self defense. If you shoot at the someone robbing you or threatening your life and in the process you hit someone or something you did not intend to, there is a high likelihood they will prosecute you. If you can’t make a given shot, you shouldn’t be pulling the trigger. You have the ultimate responsibility to use the necessary force required (and no more) to STOP the threat. You are also legally and morally responsible for not hitting the innocent. In this case, even though I agree that he had a legal right to stop this guy from accosting people, he only had that right up to a reasonable means to stop the threat. Based off news reports which isn’t the best indicator of fact I will concede I’m not sure the guy deserved to die. In that case, is causing his death considered reasonable? Ultimately this story is incredibly tragic.

    Just curious how many here remember the Gidone Busch incident in August 1999. Very similar situation to Mr. Neely’s. Very similar result.
    I don’t recall a single Jew calling the police officers heroes. I do recall the hundreds, if not thousands, of Jews that protested the killing.
    Maybe the difference is that Mr. Busch was Jewish and Mr. Neely was Black.

    The Marine should leave NY and go to Florida before he is arraigned. I am sure Desantis will not allow him to be extradited. I thought there were “good Samaritan” laws on the books that give immunity to people trying to save other people.

    This guy did not attack anyone physically, he was screaming throwing fits however, everyone saw he was nuts as he has mental issues. There was no reason to put him a headlock as he did not touch anyone.
    There was some crazy guy in my Shul recently, who was screaming, acting up and warning people to get away from him, did we have the right to do the same thing?
    As much as I hate the DA, he did the right thing in this case. Life for everyone in Precious, and even life of us Jews. For many years, a little while ago nobody knew that

    Yep. Killing someone by mistake is manslaughter. Of course there is a wide range of punishments available for manslaughter. It all depends on the circumstances. It ought to be looked into.
