The lawsuit, filed by Jonathan Fleming, 52, claims that in Nov. 2013, Hynes knew about evidence clearing Fleming of a 1989 killing of Darryl Rush  in Williamsburg section of Brooklyn, but that Hynes did nothing in the last few months as DA to get Hynes out of prison, according to the New York Post (http://bit.ly/1a5rNIe).

Current Brooklyn DA Ken Thompson’s office found a hotel receipt showing Fleming’s presence at a Florida hotel at the time of the killing. The lawsuit claims Hynes knew about the receipt in 2013.

Fleming was released in April 2014.

The lawsuit is seeking unspecified damages.
